1. Introduction and acceptance
1.1. These terms govern use of the website [TO BE COMPLETED: domain] and the fairlyhome service (together, the "Service"), through which we sell informative property reports generated from an address.
1.2. By creating an account or placing an order, you confirm that you have read and accepted these terms and the Return and Refund Policy. The way we process personal data is described in the Privacy Policy and the Cookie Policy, which inform you and do not ask for a separate consent. If you do not agree with these terms, do not use the Service.
1.3. These terms apply to consumers (individuals acting outside their professional activity) and to business users. Consumer protection provisions apply only to consumers.
1.4. The Service is intended for persons aged 18 or over.
2. Definitions
- Operator / we: the company described in section 3.
- User / you: anyone using the Service.
- Consumer: an individual acting for purposes outside their trade, business, craft or profession (GEO 34/2014).
- Account: your profile in the Service.
- Credit: a prepaid unit. 1 credit allows one (1) report to be generated.
- Report: the informative digital document generated for an address and delivered in your account.
- Partner: a person who takes part in the affiliate program and has a personal discount code (see section 10).
- Data sources: public and licensed sources of the information in the report.
- Discount code: a code giving a percentage discount on an order.
3. The Operator
The Service is operated by: [TO BE COMPLETED: company name], a limited liability company (SRL), tax ID (CUI) [TO BE COMPLETED: CUI], Trade Register No./EUID [TO BE COMPLETED: number], registered office at [TO BE COMPLETED: address], share capital [TO BE COMPLETED: optional], email [TO BE COMPLETED: contact email], phone [TO BE COMPLETED: phone]. VAT payer: [TO BE COMPLETED: yes/no].
4. Account
4.1. You need an account to buy and generate reports. You can sign in with email and password, Google or Facebook.
4.2. Account data must be accurate and current. You are responsible for keeping your password confidential and for activity in your account. Tell us immediately if you suspect unauthorized use.
4.3. You can change your name, email, password and profile photo at any time in your account.
4.4. An account is personal. Do not share it.
5. Credits and prices
5.1. Reports are obtained with credits. 1 credit = 1 report. Available packs: 1 report, pack of 3 reports. Business offers on request.
5.2. Prices are those displayed in the Service at the time of the order: [TO BE COMPLETED: prices]. For consumers, prices are shown including VAT, if the Operator is a VAT payer.
5.3. Credit validity (proposal): credits can be used for 6 months from the date of purchase. After expiry, unused credits are lost without refund, except where the law requires otherwise. We notify you by email 14 days before expiry. Credits are used in order of purchase, the ones that expire first going first.
5.4. Credits are not electronic money, earn no interest, cannot be transferred to another account and cannot be converted into cash, except as set out in the Return and Refund Policy.
5.5. We may change prices going forward. A change does not affect orders already paid.
6. Ordering and payment
6.1. Order steps: you choose a pack, enter billing details, optionally apply a discount code, confirm the order with an obligation to pay, and pay.
6.2. Payment is by card through Stripe Payments Europe, Ltd. (Ireland). Card data is processed by Stripe. We do not see or store it.
6.3. The contract is concluded when payment is confirmed and we send the order confirmation. We may refuse or cancel an order in case of suspected fraud or an obvious pricing error. If you have paid, we refund the amount.
6.4. The invoice is issued electronically through [TO BE COMPLETED: SmartBill or Oblio] and is available in your account and/or sent by email. For business customers it is also issued through the national RO e-Factura system where the law requires it. You are responsible for the accuracy of the billing data you enter, including the CUI.
6.5. Right of withdrawal. At checkout we ask for your express consent to start supplying the digital content immediately and your acknowledgment that you lose the 14 day withdrawal right once the report is generated (art. 16(m) GEO 34/2014). Details, including the more favorable option we offer, are in the Return and Refund Policy.
7. Delivery of reports
7.1. To generate a report you enter the address (county, locality, street, number) and pin it on a map. One credit is used when the report is successfully generated.
7.2. The report is delivered digitally in your account. Delivery by email: [TO BE COMPLETED: confirm feature and availability date].
7.3. Estimated generation time: [TO BE COMPLETED: time]. If a report cannot be generated or is affected by a technical error, the credit is restored under the terms of the Return and Refund Policy.
7.4. You are responsible for the accuracy of the address and the map pin. A report generated for a wrong address entered by you is not automatically restored. See the Return and Refund Policy, which also covers clear-error situations.
8. Nature and limits of the report (important)
The report is informative. Read this section carefully.
8.1. The report is NOT:
- an ANEVAR valuation and does not represent a market value;
- a technical expertise or structural assessment of the building;
- legal, tax or financial advice;
- a land book (carte funciară) extract or an encumbrance certificate;
- a substitute for checks by a notary, lawyer, technical expert, valuer or bank.
8.2. Depending on the area and available data, the report may contain: seismic risk class (where the building appears in the official AMCCRS list for Bucharest or in other official lists), flood exposure from ANAR flood hazard and risk maps (mapped areas only), public transport and points of interest (OpenStreetMap and public GTFS feeds), area information, possibly a price reference based on the notaries' valuation study (this is NOT a market valuation), and a rental yield calculator based on the rent you enter.
8.3. Data may be incomplete, outdated or contain errors from the sources. Each item shows its source and the date of the data. Verify it before any decision.
8.4. A building's absence from a list (for example the seismic list) does not mean it is safe or free of problems. A location's absence from a flood map does not mean there is no risk.
8.5. The yield calculator is indicative and depends on values you enter. It does not guarantee any return.
8.6. Coverage may be limited. At first the Service mainly targets Bucharest ([TO BE COMPLETED: confirm covered areas]). If we have no data for an address, the report will say so.
8.7. The decision to buy, sell, rent or finance a property is yours. We encourage you to consult specialists.
9. Discount codes
9.1. Partners' personal codes give buyers a percentage discount: [TO BE COMPLETED: percentage and conditions].
9.2. One code can be used per order. Codes cannot be combined with other offers unless stated otherwise.
9.3. The code is applied before payment and cannot be applied retroactively. It may have a validity period or usage limits: [TO BE COMPLETED: rules].
9.4. You may not use your own partner code on your own orders if the Affiliate Program Terms prohibit it. We may cancel codes obtained through abuse or fraud.
9.5. In case of a refund, the amount actually paid (after discount) is returned.
10. Affiliate program
The affiliate program is governed by the Affiliate Program Terms, a separate document. In case of conflict, the program terms prevail for matters within the program, and this document prevails for the purchase of reports.
11. User obligations
You agree to:
- use the Service lawfully, in good faith and in line with these terms;
- not extract data from the Service automatically (scraping, bots, crawlers) and not use automated means to generate reports in bulk, without our written consent;
- not resell, commercially redistribute or publish reports as your own product without a B2B agreement with us;
- not attempt unauthorized access, disrupt the Service or bypass security measures;
- not enter false data or data that infringes the rights of others;
- not use the Service to harass, stalk or harm a person.
We may suspend or close the account for serious breach, after notice, except in urgent cases (security, fraud). See section 17.
12. Intellectual property and data sources
12.1. The Service, its design, software, trademarks, structure and the presentation of reports belong to the Operator or its licensors (Law 8/1996 on copyright).
12.2. After payment and generation, you receive a personal, non-exclusive and non-transferable licence to use the report for your own purposes (including printing it or showing it to a notary, bank, adviser or the person you are negotiating the property with). Any other use (resale, publication, loading into databases) requires our written consent. For business: extended licence by separate agreement.
12.3. Source attribution:
- Map data and points of interest: © OpenStreetMap contributors, available under the Open Database License (ODbL) 1.0, https://www.openstreetmap.org/copyright.
- Public transport: public GTFS feeds from transport operators ([TO BE COMPLETED: operators and licences]).
- Seismic risk: official AMCCRS lists and other official lists ([TO BE COMPLETED: exact sources and licences]).
- Floods: ANAR hazard and risk maps ([TO BE COMPLETED: source and reuse conditions]).
- Price reference: the notaries' valuation study ([TO BE COMPLETED: source and reuse conditions]).
- Maps and geocoding: [TO BE COMPLETED: provider].
- Other licensed sources: [TO BE COMPLETED: list].
12.4. If you reuse parts of data derived from OpenStreetMap, the ODbL obligations (attribution, share-alike) apply to you.
12.5. Content you upload (for example your profile photo) remains yours. You grant us a limited licence to store and display it in the Service. The photo is stored at a web address that is hard to guess, but accessible to anyone who has the link. You warrant that you have the right to upload it.
13. Liability
13.1. We provide the Service with professional diligence but, given the nature of third-party data, we do not guarantee that a report is complete, current or error-free.
13.2. To the extent permitted by law, we are not liable for losses resulting from decisions taken solely on the basis of the report, or for errors, delays or unavailability of third-party sources.
13.3. Liability cap (proposal): for business users, total liability is limited to the price paid for the report concerned, over the last [TO BE COMPLETED: 12 months]. For consumers we set no general cap, but we are liable only for foreseeable and directly caused damage, under the law.
13.4. Nothing in these terms excludes or limits liability: (a) for intent or gross negligence (art. 1355 Civil Code); (b) for bodily injury, damage to health or death; (c) for any liability that cannot be excluded or limited by law, including your consumer rights, your rights under Law 193/2000 on unfair terms and those concerning conformity of digital content ([TO BE COMPLETED: applicable act, e.g. GEO 140/2021, lawyer to confirm]).
13.5. We are not liable for force majeure (art. 1351 Civil Code).
13.6. You are liable for damage caused to us by breaching these terms.
14. Availability of the Service
14.1. We make reasonable efforts to keep the Service running but do not guarantee uninterrupted availability. Interruptions may occur for maintenance, technical problems or causes beyond our control (including third-party providers).
14.2. We may change or withdraw features. If withdrawing an essential feature affects credits already paid, we refund or compensate them.
15. Business users
15.1. For business (B2B) users, the right of withdrawal and other consumer-specific protections do not apply.
15.2. Business offers (volume, extended licences, API access or others) are set by written agreement: [TO BE COMPLETED: conditions].
15.3. Invoice complaints must be made within [TO BE COMPLETED: e.g. 30 days] of issue.
16. Changes to the terms
16.1. We may update these terms, for example for legal, technical or commercial reasons. The new version is published on the site with its update date.
16.2. For significant changes, we notify you by email or in your account at least [TO BE COMPLETED: e.g. 15 days] before they take effect. If you do not accept, you can close the account and request a refund of unused credits for the remaining period, as the law provides.
16.3. Orders already placed remain governed by the terms in force on the order date.
17. Termination and account deletion
17.1. You can delete your account at any time from account settings or by request to the contact address.
17.2. Deletion is permanent and takes effect immediately from active systems, as described in the Privacy Policy, section 8. Backup copies are overwritten within at most [TO BE COMPLETED: 7 days]. Unused credits are lost, except those for which you are entitled to a refund (see the Return and Refund Policy). Consider using your credits or requesting a refund before deleting.
17.3. Orders and invoices are kept, detached from your account, for accounting obligations and for defending possible payment disputes, for the periods set out in the Privacy Policy. Accounting documents are kept for 10 years from the end of the financial year in which they were prepared (art. 25 of Law 82/1991) [TO BE COMPLETED: accountant confirmation]. Data on the invoice required by law cannot be removed from the fiscal document.
17.4. We may suspend or close an account for serious breach of the terms, with reasoned notice where the situation allows. Remaining valid credits are refunded, unless closure is caused by fraud or abuse.
18. Complaints, ANPC, ADR
18.1. Send complaints to [TO BE COMPLETED: contact email]. We reply within [TO BE COMPLETED: e.g. 30 days] (proposal), in line with GO 27/2002 on petitions where applicable.
18.2. As a consumer you may contact the National Authority for Consumer Protection (ANPC), https://anpc.ro [TO BE COMPLETED: ANPC address, to be verified].
18.3. Alternative dispute resolution (SAL): consumers may use SAL entities, under GEO 38/2015, through ANPC (https://anpc.ro, SAL section). Participation is not mandatory and does not prevent you from going to court.
18.4. The EU Online Dispute Resolution (ODR) platform was discontinued in July 2025 (Regulation (EU) 2024/3228), so we no longer present it as an active tool. [TO BE COMPLETED: lawyer to confirm current mandatory information on SOL and SAL].
19. Governing law and competent courts
19.1. These terms are governed by Romanian law. For consumers from other EU states, the mandatory protection of their country of residence is preserved, under Regulation (EC) No 593/2008 (Rome I).
19.2. Disputes are first sought to be settled amicably. Failing that, Romanian courts are competent. Consumers may sue the Operator before the court of their domicile (art. 113(1) point 11 Code of Civil Procedure, to be confirmed). For disputes with business users, the courts at the Operator's registered office are competent: [TO BE COMPLETED: court].
20. Contact
[TO BE COMPLETED: company name], [TO BE COMPLETED: address], email [TO BE COMPLETED: contact email], phone [TO BE COMPLETED: phone].
